The petitioner is apprehending his arrest in a case instituted under Sections 498 (A)/323 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
The prosecution story, in short, is that the complainant married with the petitioner on 24.5.2010 at Shiv Mandir, B.M.P. Patna-14, at the time of marriage, the complainant's father gave as a gift cash Rs. 2,00000/-, Rs. 30,000/- for clothes, utensils and Rs. 1,00000/- for ornaments. It has further been alleged that after marriage, she has gone to her
Patna High Court Cr.Misc. No.21374 of 2015 (2) dt.09-07-2015 matrimonial house. Thereafter 2 or 3 days, her husband went to Maharastra alongwith his elder brother for doing work. It has further been alleged that on 01.08.2010 mother-in-law, father-inlaw and Devar demanded a Motorcycle and Rs. 2,00000/- from her parental house and asked to complainant to bring the said demand. If you do not fulfil the demand then they abused tortured her physically and mentally. Complainant's parents were a simple farmer he could not fulfil the aforesaid demand. It has further been alleged that her Devar made a call to her husband and thereafter her husband came Gaya and took her to Maharastra on the house of his elder brother, where she lived about 2 and 1⁄2 months, thereafter husband, Bhaisur and Gotani repeated, demand of money and Motorcycle.
It has further been alleged that her husband brought her matrimonial house at Gaya her matrimonial house Family members were taken away her ornaments and clothes and pushed her from the house then she came to Maike. It has further been alleged that the complainant filed a case bearing no. 286/11 before the Bihar State Mahila Ayog on 04.03.2011.
Heard the learned counsel for the petitioner and the complainant, it has been submitted jointly that the dispute between the parties have been settled and both agreed to live
Patna High Court Cr.Misc. No.21374 of 2015 (2) dt.09-07-2015 together.
Considering the aforesaid facts and circumstances, the above named petitioner is granted bail, in the event of his arrest or surrender in the Court below shall ensure that on which date the complainant is also present in the Court and both are living together in the same house, within a period of four weeks, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Danapur, Patna in connection with Complaint Case No. 649/13 (C), subject to the conditions as laid down under Sections 438 (2) of the Cr. P.C. (Sudhir Singh, J.) Kamlesh U T
