ANJANA MISHRA ORAL ORDER 12-08-2015 A supplementary affidavit has been filed today, indicating the criminal antecedents of the petitioner. Heard learned counsel for the petitioner and the learned counsel for the State.
The petitioner is apprehending his arrest in connection with Murar P.S. Case No.47 of 2014 for allegedly having committed the offence under Sections 408, 409, 420/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that only allegation against this petitioner is that the purchases of solar lights were made not from Breda/Beltron; rather it was purchased from outside the agency. Learned counsel submits that at the relevant point of time, there was no such embargo
Patna High Court Cr.Misc. No.31189 of 2015 (2) dt.12-08-2015 2/2 and the direction was issued only later.
Considering the aforementioned submissions and that, in fact, the letter for purchase of solar lights from Breda/Beltron was issued much after the said purchases are already made, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with Murar P.S. Case No.47 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
