JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 14-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under section 395 of the Indian Penal Code.
Tata pick-up van bearing registration No. BR 21 GA 3369 was taken away by the five unknown miscreants on gun point and in the said vehicle total 2500 kg mango was kept. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No T.I. parade was held and no incriminating article was recovered from the possession of the petitioner. The petitioner is also accused in five other criminal cases in the same year, 2021.
Patna High Court CR. MISC. No.15806 of 2022(2) dt.14-07-2022 2/2 Prior to the said criminal cases, no case was lodged against the petitioner. The petitioner was remanded in this case from the case of Vidyapati Nagar P.S. Case No. 77 of 2021. The petitioner is in custody since 07.08.2021.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai, in connection with Teghra P.S. Case No. 203 of 2021, with following conditions :-
1. The bailor should be close relative of the petitioner.
2. If the petitioner is found in similar nature of offence in future his bail bond is liable to be cancelled. The application stands allowed.
