JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Forbesganj P.S. Case No. 263 of 2017 for offences under Section 399 and 402 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.
Counsel for the petitioner submits that similarly circumstanced other co-accused have been granted bail by this Court vide orders in Cr. Misc. No. 33153 (Sintu Kumar & anr) dated 20.7.2017, Cr. Misc. No. 34116 of 2017 (Shivesh Kumar) dated 20.7.2017, Cr. Misc. No. 35792 of 2017 (Niraj Kumar) dated 10.8.2017, Cr. Misc. No. 38072 of 2017 (Devilal Yadav @ Devilal) dated 10.8.2017 and Cr. Misc. No. 38356 of 2017 (Pawan Kumar) dated 19.8.2017.
Considering the fact that other co-accused have been
Patna High Court Cr.Misc. No.44319 of 2017(2) dt.21-09-2017 2/2 granted bail, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 263 of 2017, on the condition that the petitioner will extent full co-operation in the conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
