JUSTICE MADHURESH PRASAD ORAL ORDER 23-04-2019 At the very outset, counsel for the petitioner submits that relying upon decision of the Apex Court in the case of Avtar Singh vs. Union of India & others reported in 2016(8) SCC 471, he would be approaching respondent no.3 for reconsideration of his case in the light of law having regard to various parameters which are required to be considered in a case where employment of the petitioner is terminated on the ground of suppression or misrepresentation in respect of pending criminal proceeding at the time of obtaining employment. In view of said submission, consideration has to be

No useful purpose would be served by keeping writ petition pending. Petitioner will make detailed representation before respondent no.3 (Deputy Director General of Police {Administration}, Bihar, Patna) within four weeks. In the event, such representation is filed, the same shall be disposed off by reasoned and speaking order within three months thereafter. Earlier order dated 10.3.2010 passed by respondent no.3 shall not stand in the way of fresh consideration.

Writ petition is disposed off.
