The petitioner seeks bail in Sirdalla (Meskaur) P.S. Case No. 343 of 2020, registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code. As per the prosecution case, on 30.08.2020 at about 5.30 PM, informant's father Rambalak Yadav along with his uncle (Mausa) Sargun Yadav had gone to see Tajiya and when informant's father did not return, the informant went at the house of his uncle (Mausa) and asked about his father. His uncle told that he left his father at village Chak Par and came to his house. During course of search, on 31.08.2020 informant found blood stained clothes of his father in the Aahar of the village and on 01.09.2020 about 7 hours dead body of the his father found drowning in the Bandh Aahar of village. No.15476 of 2022(2) dt.16-05-2022 2/2 uncle then his uncle told that in course of drinking wine at Chak Par some altercation took place and on 30.08.2020 at about 9.00 PM he along with co-accused Shankar Yadav, Ledha Choudary @ Ramchandra Choudhary (petitioner), Kaila Mian and Fekhan Khan killed his father and threw the dead body in the Bandh Aahar of village.
It is submitted on behalf of the petitioner that there is no eye-witness of the occurrence. Only on the basis of confession of co-accused, petitioner has been made accused in this case. Similarly situated co-accused Shankar Yadav has been granted bail by this Court vide order dated 06.12.2021 passed in Cr. Misc. No. 20017 of 2021. Petitioner claims clean antecedent and he is in custody since 17.09.2021.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge V, Nawada in connection with Sirdalla (Meskaur) P.S.
