Petitioner apprehends his arrest in connection with Chenari P.S. case no. 195 of 2014, registered under Sections 409,467,468 and 471 of the IPC Petitioner was handed over charge of the school by the retiring teacher. The informant is another teacher of the school. It has been alleged that the service of the petitioner was not approved by the government yet he did not make over charge of entire records.
Learned counsel for the petitioner draws attention of the Court to Annexure-2 which is a communication sent by the petitioner to the Regional Deputy Director, Patna, explaining the circumstances under which certain records were withheld by him.
Patna High Court Cr.Misc. No.21734 of 2015 (2) dt.08-07-2015 2/2 It has been submitted that the entire records have now been made over to the school. There is no other allegation in the FIR. In the facts and circumstances of the case, this Court is inclined to extend the privilege of anticipatory bail to the petitioner. Let the petitioner, named above, in the event of his arrest/surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Chenari P.S. case no. 195 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. with further following condition:- (i) One of the bailors shall be the own/close family member of the petitioner.
