This application is for grant of regular bail in connection with Sikty (Bardaha) P.S.Case No.165 of 2017 for the offences under Sections 341, 323, 504, 363, 366A, 506, 34 and 12B of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor girl of the informant, however, submission of the learned counsel for the petitioner is that in her statement recorded under Section 164 Cr.P.C. she has stated about the story of the kidnapping but she has not stated anything else. Furthermore later on they got married and living together and a petition in this regard has been filed by the victim girl in the court of Judicial Magistrate Ist class, Araria, which is annexure 2 to this petition.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the court of C.J.M., Araria to notice the victim girl and to verify the authenticity of the petition before the court and once being satisfied with the authenticity of the petition, he shall release the petitioner in connection with Sikty (Bardaha) P.S.case No.165 of 2017 to his own satisfaction without being prejudiced by the order of this Court, otherwise, he is free to pass any other order or orders, as he deems fit and proper.

With the aforesaid observation, this application is disposed of.
