JUSTICE ARUN KUMAR ORAL ORDER 08-05-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Mahila PS Case No. 1 of 2018 registered under Section 420 of the IPC and Section 3⁄4 of the Dowry Prohibition Act.

The allegation in brief is that the petitioner's marriage was fixed with the informant's daughter but after ring ceremony he refused to marry and also not returning the money taken in dowry. Learned Counsel for the petitioner submits that the petitioner is prospective bride-groom and the marriage was negotiated by the parents but another girl was produced in ring ceremony so the petitioner refused to marry, his parents have been admitted to anticipatory bail by a coordinate Bench of this Court. Learned Counsel further submits that there is no document to show that fourteen lakh rupees was transmitted to the petitioner or to any other family member.

Having considered the said facts and circumstances, the petitioner, namely, Sanjay Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda at Biharsharif in connection with Mahila PS Case No. 1 of 2018.
