JUSTICE ARUN KUMAR ORAL ORDER 14-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 19.1.2018, seeks bail in Rivilganj PS Case No. 16 of 2018 registered under Sections 399, 402 and 414 of the IPC.
The allegation in brief is that the police on receiving secret information reached the place in the mid-night, apprehended many persons, several arms were recovered from their possession and from the possession of the petitioner one country made pistol with live cartridges was recovered.
Learned Counsel for the petitioner submits that the petitioner was apprehended on 17th but produced in the court on 19th. Learned Counsel further submits that the petitioner was not apprehended from the spot rather he was apprehended from his house, moreover Kalika Prasad Yadav and two others have been admitted to bail by this Court.
However learned Counsel for the State submits that there is criminal antecedent of the petitioner and there is recovery of loaded arms from him.
Having considered the aforesaid facts and circumstances, the prayer for bail of the petitioner is rejected. Snkumar/- (Arun Kumar, J) U T
