Petitioner seeks bail in connection with Triveniganj P.S. Case No. 101/2018 (G.R. No. 496 of 2018) for offences punishable under Sections 302, 120-B/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, as lodged by the informant, is that while she had gone to her maternal house her daughter was in the house. Her husband went for morning prayers and thereafter he was killed. It is alleged that the second wife Iza Khatoon and her son Rustam were having property dispute with her husband and on the date of occurrence the said co-accused Rustam and his friends were found taking tea near the house of the informant.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.28111 of 2018(2) dt.10-05-2018 2/2 petitioner that he is innocent, not named in the First Information Report and it is only on suspicion and being the friend of coaccused Rustam that he has been made accused. He further submits that he bears no criminal history and is not concerned with the alleged killing. He further submits that there is no eyewitness to the alleged occurrence and he is languishing in judicial custody since 21.03.2018.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-I, Supaul, in connection with Triveniganj P.S. Case No. 101/2018 (G.R. No. 496 of 2018), subject to the condition that the petitioner will cooperate in the investigation/ trial, will make available all the information and appear before the concerned police station/ court as and when required.
