JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2017 The petitioner seeks regular bail in connection with Danapur P.S. Case No. 702 of 2015, registered for offences punishable under Sections 419, 420, 467, 468 and 469 of the Indian Penal Code.
Allegation against the petitioner that he in conspiracy with other accused person produced fake cheque in the bank and withdrawn some amount.
It has been submitted on behalf of the petitioner that out and out false and fabricated allegations has been made and there is no material against the petitioner to connect with the present case rather he is accused in other cases, from where he has been remanded in the instant case.

Patna High Court Cr.Misc. No.38441 of 2017 (4) dt.08-11-2017 2/3 appearing on behalf of Canara Bank opposed the prayer for bail, however, they could not produce any material against the petitioner with regard to his involvement in the present case. Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur, in connection with Danapur P.S. Case No. 702 of 2015, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation

The court below is directed to verify the address of the petitioner as well as of the bailor before releasing the petitioner on bail.
