JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks regular bail in connection with S.T. No. 432 of 2016 arising out of Kanti P.S. Case No. 475 of 2015 registered for the offences punishable under sections 302/34 of the IPC.

Earlier the prayer for regular bail was rejected vide order dated 18.01.2017 passed in Cr. Misc. Case No. 47325 of 2016 by this Court with a direction to the trial court to expedite the trial of the petitioner.

Learned counsel for the petitioner submits that this application has been filed for grant of bail on the ground that trial has commenced and petitioner is in custody since

Patna High Court Cr.Misc. No.36325 of 2017 (2) dt.02-08-2017 2/2 05.05.2016.

Learned APP opposes the prayer for bail.

Having heard both sides, in view of the facts and circumstances, I am not inclined to enlarge the petitioner on bail and accordingly his prayer stands rejected.

However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of nine months.

With the above observation, this application is dismissed.
