The petitioner apprehends his arrest in Barahara P.S. Case No. 82 of 2016, registered for the offences punishable under Sections 377 and 511 of the Indian Penal Code. The informant alleged that his son gone to purchase eggs, but the petitioner intercepted him took him in a field and tried to commit unnatural offence with him. The alarm was raised and the petitioner fled away.
It is submitted that the occurrence is said to have taken place on 03.02.2016, but the FIR was lodged on 11.02.2016. The petitioner has falsely been implicated in this case. The informant himself got the information through telephone about the occurrence and he came to his house from Gujarat and lodged the
Patna High Court Cr.Misc. No.16464 of 2016 (2) dt.12-05-2016 2/2 case.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail in Barahara P.S. Case No. 82 of 2016, pending in the court of the learned Chief Judicial Magistrate, Bhojpur, Ara. Accordingly, the same is rejected.
