The petitioner apprehends his arrest in Udwantnagar P.S. case No. 371 of 2017 corresponding to Excise case No. 5760 of 2017 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

The gist of the allegation is that when the informant went raid the place of occurrence on the information that somebody were carrying liquor the petitioner and others after seeing the police fled away crossing over the river. The informant alleged that Chowkidar identified the petitioner and others.

The learned counsel for the petitioner submits that the entire allegation is false and concocted. The petitioner was never carrying any liquor. Similarly situated accused, Harendra

Patna High Court CR. MISC. No.14736 of 2019(2) dt.11-03-2019 2/2 Yadav and Radhe Shyam Yadav have already been granted anticipatory bail vide order dated 18.04.2018 passed in Cr. Misc. No. 21995 of 2018.

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that similarly situated accused have already been granted anticipatory bail, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV-cumSpecial Judge, Excise Act, Bhojpur, Ara in connection with Udwantnagar P.S. case No. 371 of 2017 corresponding to Excise case No. 5760 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
