ANJANA MISHRA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody since 09.07.2017 in connection with a case registered for the offences punishable under Sections 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that though he is not named in the First Information Report, his name has surfaced subsequently on the basis of the confessional statement made before the police by one Mantu Kumar which has no evidentiary value. It is submitted that there has also been no recovery from his possession.
Considering the entire facts and circumstances of the case, let the petitioner above named, be released on bail on
Patna High Court Cr.Misc. No.41169 of 2017 (2) dt.20-09-2017 2/2 furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Gaya, in connection with Wazirganj P.S. Case No. 239 of 2017.
