The petitioner in this case prays for direction to the respondents to grant 1st Modified Assured Career Progression on completion of 10 years of service in pay scale of PB-3 with Grade Pay Rs.5400, Second MACP on completion of 20 years of service in pay scale of PB-3 with Grade Pay of Rs.6600/- with effect from 28.12.2012 and for grant of Third MACP on completion of 30 years of service in Level-13 with effect from 27.06.2017 in Grade pay of Rs.8700/-.

3. During the course of hearing it has come to light that for seeking the same relief the petitioner has already filed a

Patna High Court CWJC No.4653 of 2025(2) dt.28-03-2025 2/2 representation before Joint Secretary, Rural Works Department, Bihar, Patna, but the petitioner contends that the said representation has been wrongly filed before the said authority and that it should have been filed before the Additional Chief Secretary, Rural Works Department, Bihar, Patna.

With the consent of the parties, the petitioner is granted liberty to file a fresh representation before the Additional Chief Secretary, Rural Works Department, Bihar, Patna (respondent no.3) within two weeks from the date of this order and after the receipt of the said representation the Additional Chief Secretary, Rural Works Department, Bihar, Patna, after hearing the petitioner shall decide the representation within two months thereafter. In case the decision of the Additional Chief Secretary, Rural Works Department goes against the petitioner, the petitioner would be at liberty to reagitate the matter by filing a fresh writ application.

5. With the aforesaid observations/directions this writ petition shall stand disposed of.
