Heard learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest in connection with Bhorey P.S. Case No.195 of 2020 registered for offences under Sections 341, 323, 504, 506 of the Indian Penal Code. At the very outset, learned counsel for the petitioners prays for withdrawal of the application on behalf of the petitioner nos. 2 and 3, namely, Dhananjay Sah @ Dhananjay Kumar Sah and Anjan Sah.
Prayer is allowed. The application for anticipatory
Patna High Court CR. MISC. No.26005 of 2021(2) dt.03-03-2022 2/2 bail is dismissed as withdrawn so far as the petitioner nos. 2 and 3, namely, Dhananjay Sah @ Dhananjay Kumar Sah and Anjan Sah are concerned.
So far as petitioner no.1, namely, Rite Devi is concerned, it has come during investigation that the prosecution allegation is false.
Considering the above, this application for anticipatory on behalf of petitioner no.1, namely, Rite Devi is allowed.
Accordingly, let petitioner no.1, namely, Rite Devi, in the event of her arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Bhorey P.S. Case No.195 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
