2. The petitioner seeks regular bail in a case registered for the offence under Sections 399, 402, 414 of the Indian Penal Code, Section 25(1-b)a, 26 and 35 of the Arms Act and Section 8/20(b)(ii)(c) of the NDPS Act.

3. As per the prosecution case, the petitioner and other co-accused persons were planning to loot.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is in custody since 28.11.2023. He further submits that one co-accused namely Ranjan Kumar has been granted bail by this Court vide Cr. Misc. No. 9925 of 2024 dated 20.02.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, East Champaran, Motihari/concerned Court below in connection with Kalyanpur P.S. Case No. 425 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Pipra Kothi Police Station, East Champaran on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
