The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 395/ 397 of the Indian Penal Code.
Prosecution case is that on 21.12.2014 while the informant along with his family members were sleeping in his house, eight miscreants entered into the house and tied the hands of the informant and his son when other family members made protest they were assaulted by means of 'lathi' and knife. The accused persons after breaking the lock of the boxes robbed Rs.1.50,000/-, ornaments and other articles.
It is submitted by learned counsel for the petitioner that accusation is omnibus and general. There is no recovery
Patna High Court Cr.Misc. No.16594 of 2016 (2) dt.18-04-2016 2/2 from the possession of the petitioner and maliciously the accusation has been levelled.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Chapra Mufassil P.S. Case No.262/2014, pending before the learned CJM, Saran at Chapra.
With the above observation, this application is, accordingly, disposed off.
