The petitioner seeks bail in a case registered for offences under Sections 30 (a), 38 and 41 of the Bihar Prohibition and Excise (Amendment) Act, 2016. It is contended that as per allegation, 43.56 litres of foreign liquor were recovered from the house of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 28.06.2017.
Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten
Patna High Court Cr.Misc. No.36341 of 2017(2) dt.10-08-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VI-cum-Special Judge, Excise Act, Saran at Chapra in connection with Masarakh P.S. Case No. 152 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
