====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 20-09-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner after arguing for sometime seeks permission to withdraw the anticipatory bail application and submits that petitioner was a witness in Muffasil P.S. Case No. 53 of 2021 which was instituted under the Arms Act and thus police instituted the present FIR in which the petitioner is also an accused. Learned counsel next submits that petitioner being a co-villager was called by the informant of Muffasil P.S. Case No. 53 of 2021 for becoming a witness in the FIR and the petitioner considering the request of the informant became a witness without knowing the allegations in the FIR i.e., Muffasil P.S. Case No. 53 of 2021.

After making the above arguments, the learned counsel for the petitioner seeks permission to withdraw the

Patna High Court CR. MISC. No. 15561 of 2022(2) dt.20-09-2022 2/2 present anticipatory bail application.

Permission is accorded.

In the event, if the petitioner surrenders on or before 12.10.2022, the learned trial Court shall dispose of the case of the petitioner on the same day keeping in mind the fact that petitioner was merely a witness of Muffasil P.S. Case No. 53 of 2021.
