The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 353, 307/34 of the Indian Penal Code, 27 of the Arms Act, 3/4 of the Explosive Substances Act and 17 of the Criminal Law Amendment Act.

Prosecution case is that the informant being the police officer received information that some extremists assembled to commit some offence, the raid was laid when the accused persons resorted to fire on the police force and managed to flee away. From the place of raid several Maoists literature, live cartridges and some objectionable articles were recovered. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.24026 of 2016 (2) dt.30-05-2016 2/2 that the case was registered in 2008 but the petitioner was not aware about lodging of the present case. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Derni P.S. Case No.01/2008, pending before the learned ACJM, Saran at Chapra.

With the above observation, this application is, accordingly, disposed off.
