The petitioner is in custody since 27.02.2016 in connection with Kazimohammadpur P.S. Case No. 492 of 2015 for the offence registered under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that name of the petitioner has surfaced on the basis of the confessional statement made before the police by one Surendra Mahato, who has since been granted bail by this Court in Cr. Misc. 33504 of 2016. Till date, there has been no recovery of any incriminating article from his possession nor the petitioner has been put on T.I. Parade.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.40819 of 2017 (2) dt.19-09-2017 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., - cum-Sub Judge-1, Muzuffarpur in connection with Kazimohammadpur P.S. Case No. 492 of 2015 corresponding to Trial NO. 306 of 2017.
