2. The learned counsel for the petitioner has submitted that the petitioner's prayer for bail was although rejected by this Court on 02.07.2024 in Cr. Misc.No. 21226 of 2024, but the petitioner is renewing his prayer for bail on the ground that there is no progress in the trial.
3. A report from the learned court below regarding stage of the trial was called for which is available with the record. The report shows that out of seven charge-sheeted witnesses, not a single witness has been examined till date despite the issuance of non-bailable warrant. Charges were framed on 02.09.2024.
4. The petitioner is in custody since 31.08.2023. The
Patna High Court CR. MISC. No.14918 of 2025(3) dt.20-06-2025 2/2 report shows that not a single witness could be examined after issuance of non-bailable warrant.
5. Considering the above facts and circumstances as well as the period of custody, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge III, Vaishaili at Hajipur in connection with Jandaha P.S.Case No. 275 of 2023/S. Tr.No. 625/2024, subject to the conditions that the petitioner shall cooperate in the disposal of trial and make himself available on each and every date fixed at the trial, and if he fails to appear on two consecutive dates, unless he is prevented by extremely adverse circumstances, the court below shall be at liberty to cancel his bail bond.
