The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273 and 120(B) of the Indian Penal Code and Section 30 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 7.4 litres and 2640 litres country made liquor were recovered from a Scorpio vehicle and truck respectively. It is further contended that on the basis of confessional statement of co-accused, Rupesh Kumar @ Rupesh Choudhary, petitioner has been implicated in this case. Petitioner claims that he is having clean antecedent and is in custody since 23.06.2017. Having regard to the facts and the circumstances of

No.37279 of 2017(4) dt.25-08-2017 2/2 the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Court, Excise Rohtas at Sasaram in connection with Nokha P.S. Case No. 70/17.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
