1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 64, 83 and 3(5) of the BNS as well as Sections 4 and 12 of the POCSO Act.

3. Learned counsel for the petitioners submits that from perusal of the office report dated 19.06.2026, it would manifest that the notice has been received by opposite party no. 2 but then opposite party no. 2, despite receiving the notice, chooses not to appear and contest. It is further submitted that the informant alleges that Mithilesh entered his house and in absence of family members raped his daughter on point of gun

Further, after committing rape, Mithilesh put vermillion on the forehead of the victim and took her to his house and kept her at his house the entire night and in the morning brought the victim back and left her.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that petitioners are mother, father and brother of Mithilesh. It is next submitted that it absolutely defies all logic, wisdom and reasonable human behaviour that parents along with son would guard the house of the victim and facilitate rape by another son. It is also submitted that thrust of the allegation is against Mithilesh.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel appearing on behalf of the petitioners, let the petitioners, above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where
