The petitioner, in the present case, is seeking regular bail in connection with Bodh Gaya P.S. Case No.332 of 2015, registered for offences alleged under Sections 147, 148, 149, 323, 302, 304/34 of the Indian Penal Code and Sections 3 / 4 of the Prevention of Witch (Daain) Practices Act, 2001. Learned counsel for the petitioner submits that there are general and omnibus allegations against all the accused persons in the present case. It is further submitted that, vide Annexure-2 to the present application, four co-accused persons against whom there are general and omnibus allegations just like the petitioner have been granted regular bail by a coordinate

Patna High Court Cr.Misc. No.36369 of 2017 (2) dt.10-08-2017 Bench of this Court.

Learned APP though opposed the prayer for bail, but cannot distinguish the case of the present petitioner with those who have been granted regular bail by a coordinate Bench of this Court.

Considering the facts and circumstances of the case, let the petitioner, namely, Bucha Manjhi @ Raj Kumar Manjhi be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No.332 of 2015, subject to the conditions U/S 437(3) Cr.P.C.
