JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 19-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under sections 414 and 120(B) of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
On a secret information, when the police raided the Begusarai Bus Stand, one miscreant tried to escape on seeing the police but he was apprehended by the police who disclosed his name as Mintu Kumar @ Gachhi Paswan. On search, a
Patna High Court CR. MISC. No.15899 of 2022(2) dt.19-07-2022 2/3 loaded country made katta and two live cartridges were recovered from the possession of the petitioner. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. On the confessional statement of the petitioner the police raided the house of co-accused Chiranjivi, where two miscreants were present and on the search of the said house one country-made pistol and one live cartridge were recovered under the bed from the room. The petitioner is also accused in six other criminal cases as stated at para 3 of the bail petition. The petitioner is in custody since 22.09.2021.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, in connection with Begusarai Town P.S. Case No. 586 of 2021, with following conditions:-
1. One of the bailor must be a close relative of the petitioner.

2. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
3. If the petitioner is found involved in other criminal cases, his bail bond is liable to be cancelled. The application stands allowed.
