The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code.

The prosecution case relates to dowry death due to non-fulfillment of dowry demand after that this case has been lodged against the petitioners along with co-accused persons. Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. The petitioners are mother-in-laws and sister-in-law of the

Patna High Court CR. MISC. No.16293 of 2023(2) dt.10-05-2023 2/2 deceased due to which they have falsely been implicated in this case. The petitioners have no concern mess and business of the deceased as well as her husband and living separately from both of them and husband of the deceased is already in judicial custody. It is further submitted that the petitioners have got no criminal antecedent. Moreover, they are languishing in judicial custody since 20.10.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Baheri P.S. Case No. 314 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVII, Darbhanga, Distt Darbhanga.
