The petitioner seeks bail in anticipation of his arrest in connection with Biraul P.S. Case No. 139 of 2020 instituted for the offences under Sections 341, 323, 324, 379, 354(B), 325, 307 and 504/34 of the Indian Penal Code.

The petitioner is alleged to have given a farsa blow on the informant, but the injuries suffered by the victim are

Patna High Court CR. MISC. No.25658 of 2021(2) dt.25-05-2022 2/3 stated to be simple in nature. Apart from this, it has been submitted that there has been a delay of twenty one days in lodging the case without there being any explanation for such delay.

There is a counter version of the occurrence also, but the counsel for the petitioner has not provided any detail of such counter case except for the case number, which statement has been made on the basis of entries in the impugned order rejecting the prayer of anticipatory bail of the petitioner.

However, taking into account the fact that there is a dispute between the parties and there are competing claims, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Biraul, Darbhanga in connection with Biraul P.S. Case No. 139 of 2020, subject to the conditions laid down under Section

Patna High Court CR. MISC. No.25658 of 2021(2) dt.25-05-2022 3/3 438(2) of the Cr.P.C.

While saying so, this Court has also taken note of the fact that the petitioner does not have criminal records. The application stands allowed.
