Vide order dated 08.09.2021, report was called for from the court of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 784 of 2020 as to why and under what circumstances bail has been granted to the petitioner, albeit the bail application of the petitioner is pending before this Court for consideration.
In pursuance to the order dated 08.09.2021, report has been received and kept at Flag-A, in which it is reported that in the bail application filed before the learned court below, petitioner has stated that now no any bail application is pending in any superior court. Learned counsel for the petitioner has also orally submitted that the bail application filed before the Hon'ble High Court has been withdrawn, therefore, considering

No.26042 of 2021(3) dt.28-10-2021 2/2 the period of custody and the fact that other accused persons were already granted bail by the court of A.D.J, Xth Kaimur at Bhabua, petitioner was allowed bail by the learned court below. In such view of the matter, it amply clear that petitioner has tried to suppress the material fact before this Court. Hence, on the ground of suppression of material fact, the learned court below is directed to cancel the bail bond of the petitioner forthwith and take necessary steps in accordance with law.
