The petitioner is facing accusation in Sikandra P.S. Case No. 44 of 2014 registered under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.

Precisely, the allegation is that the petitioner obtained all documents including I.D. of the wife of the informant for obtaining loan. Loan was never sanctioned. When enquiry was made, the petitioner disclosed that loan was not sanctioned. Subsequently, it was revealed that a sum of Rs. 50,000/- was sanctioned by the Branch Manager out of which Rs. 36,000/- was withdrawn.

Contention of the petitioner is that it is the Branch

Patna High Court Cr.Misc. No.22144 of 2015 (2) dt.09-07-2015 2/2 Manager and others who have granted the loan. The petitioner, due to village politics, has been named. It has also been stated that some of the co-accuseds in the present case have since been released on anticipatory bail by the Court below. Be that as it may, considering the allegation made in the F.I.R., I am not inclined to privilege the petitioner with anticipatory bail. Prayer is declined. Let the petitioner surrender and seek bail which shall be considered on its own merit by the Court below uninfluenced by the present order. (Kishore Kumar Mandal, J) Pankaj/- U T
