2. Petitioner seeks regular bail in connection with Nokha P.S. Case No. 379/ 2024 dated 11.10.2024 registered for the offence(s) punishable under Section(s) 96/ 3(5) of B.N.S.
3. The main submissions advanced by the petitioner's counsel are that the victim herself appeared before the I.O. at the Police Station with her father and recorded her statement before the Judicial Magistrate in which she has not made any allegation against the petitioner and stated that she voluntarily went with the petitioner to Patna and did not reveal any fact as to persuading her in leaving the custody of her Guardian by the petitioner at that time. It is further submitted that the petitioner has fair and clean antecedent and he has been languishing in jail
Patna High Court CR. MISC. No.17158 of 2025(2) dt.11-04-2025 2/2 since 16.10.2024 and against him, investigation has been completed.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the aforesaid submissions advanced by the petitioner's counsel and mainly taking into account the petitioner's fair and clean antecedent as well as the factum of the recovery of the victim and completion of investigation against the petitioner, this court is inclined to grant the relief of regular bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Nokha P.S. Case No. 379/ 2024 on furnishing bail bond of Rs.20,000/- ( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
