The petitioners, four in number, apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code.
The informant named 20 persons in the F.I.R. along with other 30-40 unknown persons and alleged that they assaulted the informant and her family members. The informant did not make any specific allegation against the petitioners, namely, Baliram Mahto, Rambabu Mahto, Janmejay Mahto and Bhirgu Mahto. It is submitted that Paharpur P.S. Case No. 54 of 2014 was registered under Section 302 and other sections of the Indian Penal Code against the informant and others and the present case is
Patna High Court Cr.Misc. No.21306 of 2015 (2) dt.07-07-2015 2/2 lodged only to save the skin.
Considering the fact that no specific allegation is made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Paharpur P.S.
