JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-01-2015 The learned counsel does not want to press the bail application of petitioner no. 1 and accordingly, this application is hereby dismissed as not pressed against the petitioner no. 1. Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners, apprehending their arrest in connection with Sakra (Bariyarpur O.P.) P.S. Case No. 136 of 2013, registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code, seek the privilege of pre-arrest bail.

It is submitted that petitioner nos. 2 and 3 are old father-

Patna High Court Cr.Misc. No.30187 of 2014 (2) dt.19-01-2015 in-law and mother-in-law and there is no specific allegation against them and as such, they deserve sympatric consideration as written application has been lodged on 25.03.2013 for the alleged occurrence of dated 23.03.2012 and there is no eye witness. The learned A.P.P. fairly submits that F.I.R. has been lodged after much delay.

In the facts and circumstances as stated above, the petitioner nos. 2 and 3 namely, Shiv Balak Ram and Chinta Devi, in case of their arrest or surrender within two months from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Sakra (Bariyarpur O.P.) P.S. Case No. 136 of 2013, subject to the conditions as laid down under Section 438(2) Cr. P.C.
