The petitioner seeks bail in connection with Pipra P.S. Case No. 73 of 2017 dated 19.04.2017 instituted for the offences under Sections 392 of the Indian Penal Code. The informant was looted on the point of fire arm and was divested of cash of Rs. 1, 20,000/- and his personal belongings viz. mobile, laptop and recharge coupon worth Rs. 1,25,000/-.
Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R and his name only surfaced on the confession of a co-accused. Under similar circumstances, one Santosh Sahani has been granted bail by a Bench of this Court. The petitioner is in custody since 28.06.2017.
Patna High Court Cr.Misc. No.43497 of 2017 (4) dt.08-12-2017 2/2 It has also been submitted by learned counsel for the petitioner that in the cases which were lodged against the petitioner earlier to the lodging of the present case, the petitioner is on bail in all of them.
Regard being had to the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Pipra P.S.
