The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354, 325 and 307 of the Indian Penal Code.
The prosecution case is that on 30.11.2015 at 5.30 A.M. the daughter of the informant was going to take tuition when three boys assaulted her with cricket wicket. The daughter of the informant identified the petitioner and one other person.
It is submitted by learned counsel for the petitioner that accusation of assault is against three persons when
Patna High Court Cr.Misc. No.17483 of 2016 (2) dt.25-04-2016 2/2 only one injury has been found simple in nature. It is further submitted that during investigation the daughter of the informant suggested that she was assaulted by Vivek Kumar. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Masaurhi P.S. Case No. 444 of 2015 pending in the court of learned Sub-divisional Judicial Magistrate, Masaurhi, Patna.
