JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, who is in custody since 18.01.2020, seeks bail in connection with Turkauliya P.S. Case No. 620 of 2019, dated 31.08.2019, instituted for the offences under Sections 272, 273/34 of the Indian Penal Code and 30(a), 38(i), 41(i) of the Bihar Prohibition and Excise Act.

On secret information that a consignment of liquor is being unloaded by seven persons, the police proceeded to the place where the liquor was being unloaded. The miscreants are said to have run away. The petitioner has been named as one of such persons who was unloading the liquor.

Patna High Court CR. MISC. No.13366 of 2020(2) dt.03-03-2020 2/2 Learned counsel for the petitioner has questioned the source of information to the police regarding the name of such persons including the petitioner. However, he has submitted that some of the persons who have been named in the F.I.R. have been granted anticipatory bail. The petitioner earlier was made accused in a case of similar nature but he is on bail in the aforesaid case.

Considering the nature of accusation of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge-cum-Special Judge, Excise, Motihari, East Champaran in connection with Turkauliya P.S. Case No. 620 of 2019.

The application stands allowed.
