The petitioner apprehends his arrest in connection with Koilwar P.S. Case No.73 of 2019 registered under Sections 341, 323, 337 and 353 of the Indian Penal Code and Sections 30(a), 37(b)(c) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner rather recovery has been made from the heap of garbage near Dalit Tola. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the

Patna High Court CR. MISC. No.18340 of 2023(2) dt.19-05-2023 2/2 parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Exclusive Special Excise Court No.II, Bhojpur at Ara in connection with Koilwar P.S. Case No.73 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
