2. The petitioner apprehends his arrest in a case registered for offence under Sections 379, 420, 414 and 34 of the Indian Penal Code.

3. As per prosecution case, while the informant was trying to withdraw money from ATM machine, three persons came and fraudulently took possession of his ATM card and thereafter, tried to flee away, however; one person was caught, who disclosed his name as Pawan Kumar @ Chandan and also disclosed the name of petitioner and other co-accused, who fled away from the spot.

4. It is submitted on behalf of petitioner that name of the petitioner has transpired on the basis of confessional statement of co-accused Pawan Kumar @ Chandan. Save & except confession, there is nothing against this petitioner.

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that from the possession of co-accused, who was apprehended on spot, five ATM cards of different banks and other articles were seized. Besides this, petitioner has got one criminal antecedent of similar nature.

6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
