JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner, the State and the opposite party no.2.

Petitioners apprehends arrest in a case registered for the offence punishable under sections 498A/379/354B and other allied sections of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act.

As per the prosecution case, petitioners along with other family members committed torture on the informant/ opposite party no.2 due to non-fulfilment of dowry demand. Learned counsel appearing for the petitioners submits

Patna High Court CR. MISC. No.16310 of 2023(2) dt.16-05-2023 2/2 that the petitioners are father-in-law and brother-in-law of the victim. They are separate in mess and business. Allegation of torture are general and omnibus in nature against them. Thrust of allegation is against the husband of the victim. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Beguserai in Complaint Case No. 492 of 2022, subject to the conditions laid down under section 438 of the Code of Criminal Procedure.
