Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that three named accused persons along with two unknown accused came armed with weapons and kidnapped her minor daughter by a Bolero vehicle, further she suspects that her daughter might be raped and killed.

The learned counsel submits that the petitioner has been falsely implicated in the present case. It is also submitted

No.19333 of 2024(2) dt.12-03-2024 2/2 that the victim came back and her statement was recorded under Section 164 Cr.P.C. wherein she has disclosed her age 19 years and has not supported the case of the prosecution even remotely, rather has shown her willingness to accompany her in-laws, i.e., parents of the petitioner with whom she got married. It is next submitted that the victim got married to the petitioner and out of the wedlock, a child was also born.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Singhiya P.S. Case No. 33 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
