JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Bela P.S. Case No.212 of 2014, disclosing offences under Sections 414 and 420/34 of the Indian Penal Code.

The petitioner was found in possession of stolen motorcycle. On seeing the police, he is said to have fled away and was identified by the local Chowkidar. Upon enquiry, it transpired that the registration number

Patna High Court Cr.Misc. No.15961 of 2016 (4) dt.14-07-2016 2/2 of the said motorcycle, as mentioned on the number plate, was, in fact, of a tractor, as per the report of the District Transport Officer.

There is also mention of criminal antecedent of the petitioner in the case diary.

Considering the nature of accusation, I am not inclined to grant the petitioner, above named, the privilege of anticipatory bail.

This application is, accordingly, rejected.

The petitioner is directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant anticipatory bail.
