The petitioner, in custody since 28.03.2018, seeks bail in connection with Aurangabad (Town) P.S.Case No. 94 of 2018 registered under Sections 147, 148, 149, 160, 295A, 307, 353, 427 and 504 of the Indian penal Code.

It is contended that more than 200 persons have been made accused in this case relating to communal riot on the occasion of the procession of Ram Navmi, however, no specific overt act is alleged against the petitioner and similarly situated other accused persons have been admitted to bail by this Court as well as by co-ordinate Benches of this Court and this petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Kumar Saurabh, is directed to be released

Patna High Court Cr.Misc. No.30551 of 2018(2) dt.17-05-2018 2/2 on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Aurangabad (Town) P.S. Case No. 94 of 2018.
