Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366, 366(A) of the Indian Penal Code.

The accusation is of kidnapping the daughter of the informant.

It is submitted by learned counsel for the petitioner that victim is aged about 22 years and has married with the petitioner and both the petitioner and the victim are residing together.

The petitioner undertakes to produce the victim girl before learned court below on 27th of July, 2015 when it is expected from the learned Court below to record the statement of the victim. It is also expected from the learned Court below that if the petitioner files an application with a

Patna High Court Cr.Misc. No.21886 of 2015 (2) dt.23-06-2015 2/2 prayer for proper security then police authorities shall be directed to provide the same.

Considering the present stand of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for a period of three months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Town Motihari P.S. Case No. 21 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The provisional bail of the petitioner shall be confirmed by learned Court below, if the victim girl admits that she, of her own married with the petitioner. Otherwise, the petitioner will surrender and pray for regular bail. (Dinesh Kumar Singh, J) Shageer/- U T
