The petitioner seeks bail in a case instituted for the offences under Section 37(B) of the Bihar Prohibition and Excise Act, 2016.
Prosecution case, in short, is that the petitioner has consumed liquor and abused the public.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.03.2018. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that the petitioner has consumed liquor and abused the public. Nothing incriminating has been recovered from the conscious possession of the petitioner.
On behalf of the State, it is submitted that the petitioner is
Patna High Court Cr.Misc. No.29005 of 2018(2) dt.10-05-2018 2/2 named in the F.I.R./complaint case.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Banka in connection with Belhar P.S. case No.80 of 2018.
