The petitioner seeks bail in a case registered under Sections 366(A), 504, 506/34 of the Indian Penal Code. Allegation is that one Chandan Kumar kidnapped the daughter of the informant with intention to marry with her. The informant went to the house of Chandan Kumar and asked about her daughter, the accused persons started hurling abusive words and threatened him to face dire consequences. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.12.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is the uncle of the co-accused, namely, Chandan Kumar with whom
Patna High Court CR. MISC. No.14550 of 2020(2) dt.03-03-2020 2/2 the victim is said to have eloped. The petitioner has got no concern with the alleged occurrence. He has been made accused just because he happens to be the uncle of co-accused Chandan Kumar. No specific role has been alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Majhaulia (Manjhauliya) P.S. case No.618 of 2019.
