Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 506, 342 and 498(A) of the Indian Penal Code.

Petitioner is said to have ousted his wife from her matrimonial home in association with his family members for non-fulfillment of dowry demand.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. It is further submitted that petitioner is ready to pay Rs. 2,000/- per month to the informant as maintenance.

Learned counsel for the informant has vehemently

Patna High Court CR. MISC. No.33021 of 2021(2) dt.26-10-2021 2/2 opposed the prayer for bail of the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail, in the event of his/her arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Jakkanpur P.S. Case No.134 of 2020 subject to the condition as laid down under Section 438(2) of the Cr.P.C with following condition/direction:- The petitioner is directed to pay maintenance of Rs. 2,000/- per month to the informant and, if the petitioner fails to pay maintenance of Rs. 2,000/- per month for two consecutive months the bail bond of petitioner shall be cancelled by court below. The above arrangement will remain effective till any order for maintenance is passed by Family Court/competent court.
