JUSTICE ARUN KUMAR ORAL ORDER 15-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 15.11.2017, seeks bail in Hathwa @ Hathua.. PS Case No. 150 of 2017 registered under Section 394 of the IPC.
Learned Counsel for the petitioner submits that the FIR is against unknown, neither any recovery of any incriminating robbed material was recovered from the possession of the petitioner nor he was put on TIP, charge sheet has been submitted, only material transpired against the petitioner is disclosure of his name by coaccused in his statement before the police, however the petitioner had no criminal antecedent prior to institution of the case but subsequently made accused in one case on the basis of same confessional statement and has been in custody since 15.11.2017. Having considered the said facts and circumstances, the petitioner, namely, Deepak Ram is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Gopalganj in connection with Hathwa @ Hathua PS Case No. 150 of 2017.
